The undersigned declares to the best of his/her knowledge and believe the above statements are true and that no material information has been withheld. Signing this form does not bind the proposer to complete the insurance but it is agreed that this form shall be the basis of the contract should a policy be issued. You are reminded that it is your duty to disclose all material facts to insurers. A material fact is one which would influence the judgement of a prudent insurer in his consideration of the risk. Any material change in facts previously disclosed in connection with the insurance should be advised to use if the coverage is to be amended or if the period of cover is to be extended at renewal. If you have any doubt whether a fact is material you should disclose it. Insurers may have grounds for avoiding the insurance or you have prejudiced your rights to recover in the event of a claim if it transpires that there has been a failure of such a disclosure. Article 1.4 and 1.5 NBW apply.
Artikel 1.4. en 1.5 bepalen dat een verzekeringsovereenkomst ongeldig is, indien u bij het aanvragen van de verzekering onjuiste of onvolledige informatie verstrekt. Uw plicht om informatie te verschaffen omvat alles wat voor de maatschappij van belang kan zijn voor de beoordeling van het te verzekeren risico. Het gevolg van "verzwijging", ook al was u zich deze niet bewust, is dat de maatschappij zich op ongeldigheid van de overeenkomst kant beroepen en schadevergoeding kan weigeren. Door u verstrekte gegevens kunnen deel uitmaken van de door CMC Marine & Aviation en haar verzekeraar gevoerde persoonsregistratie, waarvan CMC Marine & Aviation en haar verzekeraar de houders zijn. Deze persoonsgegevens kunnen eveneens deel uitmaken van de door de verzekeraars in verenigingsverband gevoerde informatiesystemen, bedoeld voor een verantwoorde acceptatie van nieuwe verzekeringen. Op deze persoonsregistraties zijn de wettelijke privacyregels van toepassing. Een geoffreerde premie kan om markttechnische redenen nog worden aangepast. Indien opdrachtgever vóór aanvang van de verzekeringstermijn, een lagere premie geoffreerd krijgt van een derde en hiertoe het schriftelijk bewijs aan CMC Marine & Aviation overlegt, krijgt opdrachtgever, onder navolgende voorwaarden, alsnog de lagere premie. Uit dit schriftelijke bewijs moet blijken dat de verzekeraar het risico ook daadwerkelijk en op vergelijkbare wijze, wenst te accepteren. Indien de opdrachtgever vóór aanvang van de verzekeringstermijn een lagere premie geoffreerd krijgt van een verzekeringsmaatschappij waarvoor CMC Marine & Aviation geen intermediair is, geeft CMC Marine & Aviation de opdracht aan opdrachtgever terug indien de bij CMC Marine & Aviation aangesloten verzekeraars hun premie niet wensen of kunnen aanpassen en is geen partij gehouden de opdracht te aanvaarden of te doen uitvoeren. Iedere door CMC Marine & Aviation verstrekte offerte is onder voorbehoud van een volledig ingevuld opdrachtformulier en finale acceptatie door verzekeraars.
